Terms and conditions
The terms on which Servotag Pro is provided. Servotag Pro is offered exclusively to businesses.
Last updated: 2026-10-11
1. Scope and contracting parties
These terms govern every contract between the provider named in the imprint and the customer concerning the use of Servotag Pro. Servotag Pro is offered exclusively to businesses within the meaning of § 14 BGB, legal persons under public law and special funds under public law; by ordering, the customer confirms acting in the exercise of their commercial or independent professional activity. Terms of the customer that conflict with or deviate from these terms become part of the contract only if we have agreed to them in text form.
2. Registration, conclusion of contract and order button
Registering an account does not by itself conclude a paid contract. A paid contract is concluded only in the billing area of the application: the customer enters the company details (company name, billing address, country and, for a company established in another EU member state, the VAT identification number), selects a plan and is then shown, immediately above the order button, the service, the net price, the term and the notice period. The button is labelled “Order with obligation to pay”. For card payment it opens the payment step with our payment service provider Stripe – its payment form in the billing area or its payment page; the contract is concluded as soon as the payment that the customer confirms there has been completed successfully. For Series, Professional and Scale the customer may instead choose a Stripe invoice paid by bank transfer where this route is offered; clicking the button then places a binding order, and the invoice follows to the saved billing email after processing. On both routes the customer first accepts the current terms and the data processing agreement. A company established in an EU member state other than Germany can order only with a valid VAT identification number confirmed in the EU VIES database. All fixed plans (Starter, Series, Professional and Scale) can be ordered directly online. A personal offer is required only for custom Enterprise requirements. We accept an order by invoice by confirming it, at the latest by providing the paid service. The contract language is German or English. The contract text is stored by us and is available to the customer at any time in the billing area.
3. Description of the service
Servotag Pro gives each of the customer’s machines a QR-addressable machine record: documentation, released troubleshooting, spare-part links, maintenance plans and history, fault reports and read-only operator access. Servotag Pro is a documentation and communication layer. It does not connect to, read from or write to machine control systems, and it neither performs nor prescribes maintenance or repairs. Servotag Pro is not a safety, emergency-call or machine-monitoring system. It does not replace required manufacturer documentation, risk assessments, training or protective measures. Work must be carried out only by appropriately qualified and authorized personnel observing the applicable safety requirements.
4. Customer content and responsibility
The customer decides which manuals, procedures, safety notes and maintenance intervals are published, and is responsible for their accuracy, completeness and lawfulness — including compliance with the machinery, product-safety and documentation rules that apply to their equipment. We do not review the customer’s technical content and do not write machine-specific instructions. General starter topics that we offer as templates are non-binding samples without reference to any particular machine; they only become visible once the customer adopts, reviews and publishes them. Content marked as publicly visible is retrievable by anyone holding the corresponding QR link; the customer chooses that visibility. The customer keeps its users’ login credentials secret and informs us without delay of any suspected misuse. Data the customer needs outside Servotag Pro, for instance for its own systems or its own retention obligations, it additionally backs up itself, for example through the CSV export; our own obligation to back up data remains unaffected.
5. Availability
We operate the service with due care and strive for high availability; where possible, we announce maintenance in advance. Specific availability commitments apply only where expressly agreed in text form.
6. Prices, VAT and payment
All prices are net. German VAT of 19% is added only for customers established in Germany. The provider is not a small business within the meaning of § 19 UStG and accounts for VAT on the basis of payments received (§ 20 UStG). Where the service is supplied to a business established in another EU member state that provides a valid VAT identification number, the liability for the tax passes to the recipient; the invoice is issued without German VAT, bearing the note “reverse charge — the recipient of the service is liable for the tax” and stating both VAT identification numbers (§ 14a (1) UStG). The provider’s VAT identification number is DE338072244; the number given by the customer is validated. The fee is payable monthly in advance. Fixed plans are paid through Stripe by card (with 3-D Secure, also via Apple Pay or Google Pay) where the order page offers card payment for the plan; a payment method is then required when the order is placed. Customers established in Germany receive an invoice showing 19 % German VAT. Customers established in another EU member state receive an invoice without German VAT under the reverse-charge procedure; without a valid, confirmed VAT identification number no online order is possible. Customers established outside the EU receive an invoice without German VAT bearing the note “Not subject to German VAT – place of supply outside Germany (Sec. 3a (2) German VAT Act)”. For Series, Professional and Scale the customer may choose a Stripe invoice where this route is offered, payable by bank transfer within 7 days. Custom Enterprise offers are also paid by Stripe invoice unless the offer states otherwise. The paid plan is activated once the payment has been received. If a payment has not been received 3 days after it is due, access to the paid functions is paused automatically until the payment is received and is restored immediately afterwards; stored data is not affected, and the public machine pages remain available as described in clause 7. If the card payment still fails after repeated attempts within 14 days, the subscription ends; fees accrued until then remain payable.
7. Term, renewal and termination
Unless agreed otherwise, the contract runs for one month. The minimum term equals that billing period. It renews automatically by a further month unless it is terminated before the end of the current billing period. Either party may terminate without giving reasons with effect from the end of the current billing period (for payment by invoice: the end of the calendar month); the right to terminate for cause remains unaffected. The customer terminates in text form, in the billing area of the application, for card payment through Stripe also in the billing portal, or without signing in on the page “Cancel contracts here” (/legal/cancel), which is linked in the footer of every page. The customer can export their data as CSV at any time during the term. After the contract ends, access to the administration application is closed; stored data is deleted on the customer’s request. No automatic deletion after a fixed period takes place, and none is promised. The public machine pages behind the QR plates remain available until the end of the last paid billing period; after that a scan shows a notice page carrying the customer’s stored contact details. This ends the public hosting only, not the storage: the data is kept, and taking out a plan makes every plate available again unchanged.
8. No right of withdrawal
Servotag Pro is offered exclusively to businesses. The statutory right of withdrawal for distance contracts with consumers does not apply.
This service is ordered for business purposes. A contract genuinely concluded by a business customer does not carry the German statutory consumer distance-selling right of withdrawal; no waiver of that right is needed. The actual purpose of the transaction is decisive. Checking a business-customer box does not remove mandatory rights.
Fees and due dates follow the confirmed order or accepted offer. A subscription pays for the agreed availability of the service during the billing period. Choosing not to use a properly provided service, or no longer needing it, does not by itself entitle you to a refund. Ordinary cancellation stops future renewals at the agreed date; it does not make properly performed earlier services free of charge retrospectively.
Personal onboarding, setup or custom work is owed and charged only where its scope and any separate price were expressly agreed before ordering. Agreed work actually performed remains payable following ordinary cancellation alone. Starting setup does not fully perform an ongoing subscription. Undelivered work, defects and valid termination for cause are assessed under the contract and applicable law; these terms do not exclude all refunds.
Legal remedies for non-performance, defects, unauthorised or duplicate charges and mandatory local protections remain available, including for US customers. Rights against your bank, card issuer and payment provider are not waived. You may raise concerns with the contact in the legal notice; contacting us first is not a condition for statutory rights. A chargeback alone does not finally decide the underlying contractual claim; an entitlement that has validly been refunded will not be collected again.
9. Rights of use
The customer receives a non-exclusive, non-transferable right to use the service for the term of the contract. The customer retains all rights to the content they upload and grants us only the rights needed to operate the service.
10. Defects and updates
The statutory provisions apply.
11. Liability
(1) We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and to the extent of any guarantee we have expressly given.
(2) If we breach a material contractual obligation through slight negligence, our liability is limited to the foreseeable damage typical of this type of contract at the time the contract was concluded. Material obligations are those whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance the customer may regularly rely.
(3) Liability for slight negligence is otherwise excluded.
(4) These limitations also apply in favour of our vicarious agents and assistants.
(5) Towards businesses, liability for lost profits and other indirect damages is excluded in cases of slight negligence, unless such damages are typical for the contract and foreseeable.
(6) Strict liability for defects already present when the contract is concluded (§ 536a (1), first alternative, German Civil Code, BGB) is excluded.
(7) Claims under paragraph 2 become time-barred one year after the statutory limitation period begins, unless paragraph 1 applies.
Liability for fraudulently concealed defects remains unaffected; none of these provisions changes the burden of proof to the customer’s disadvantage. Servotag Pro does not access machine control systems. Reviewing and approving the customer’s technical content and performing maintenance or repair work remain the responsibility of the customer or the qualified personnel carrying out the work; our liability for our own breaches of duty remains governed by the paragraphs above.
12. Data protection and processing on the customer’s behalf
Where we process personal data on the customer’s behalf, we do so under the data processing agreement pursuant to Art. 28 GDPR published on this site, which forms part of the contract. Details are set out in our privacy policy and in that agreement.
13. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If the customer is a merchant, a legal person under public law or a special fund under public law, or has no general place of jurisdiction in Germany, the place of jurisdiction is Gummersbach, Germany, to the extent permitted by law. Mandatory statutory places of jurisdiction remain unaffected. The choice of law and venue does not displace overriding mandatory law applicable to the particular case. No limitation, exclusion or shortened claim period in these terms applies where it is prohibited by that law. In particular, agreed service obligations and remedies that cannot lawfully be excluded remain intact; a loss is not excluded merely because it is described as indirect or consequential. These terms do not require arbitration or waive any non-waivable right to bring a claim. Business-only eligibility describes who may order; it does not remove statutory protections that also cover business purchasers, including applicable Australian consumer guarantees and small-business unfair-contract protections or New Zealand small-trade protections. No general contracting-out of those protections is agreed here. The language of this website does not determine the governing law, the seller or the place of jurisdiction. Should a provision be or become invalid, the validity of the remaining provisions is unaffected.
Servotag Pro is a product of Neithra Technologies, a sole trader business of Fabian Lorenz, not entered in the commercial register, Gummersbach, Germany. These documents are governed by German law. Servotag Pro is offered exclusively to businesses.
